The right to health without discrimination is captured in various international instruments.
- The World Health Organization (WHO) Constitution states that “enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition”.
- The United Nations Convention on the Rights of Persons with Disabilities (CRPD) also addresses the right to health for people with disabilities.
- Article 25 requires States to “recognize that persons with disabilities have the right to the enjoyment of the highest attainable standard of health without discrimination on the basis of disability”.
- Together with Articles 20 (personal mobility) and 26 (habilitation and rehabilitation), it also outlines measures States Parties should undertake to ensure that people with disabilities are able to access health services that are gender-sensitive, including health-related rehabilitation.
